West Virginia sued the U.S. Department of Homeland Security for terminating a border security program, allegedly without considering the potential effects on fentanyl smuggling across the border.
The Migrant Protection Protocols, established by the DHS in December 2018, were launched by the Trump administration to deter immigrants without legal authorization to cross the southwest border of the U.S. Under the program, asylum applicants were returned to Mexico while awaiting review of their claims. The program was suspended in January by the Biden administration and then terminated in June, according to the complaint.
