South Fork Coal Co. was hit with a lawsuit alleging that it exceeded its wastewater permits’ limits on pollutants discharged from three West Virginia surface mines, in violation of Clean Water Act and the Surface Mining Control and Reclamation Act.
West Virginia Highlands Conservancy and Appalachian Voices filed a complaint Monday in the US District Court for the Southern District of West Virginia, accusing South Fork of exceeding effluent limitations for various pollutants—including iron, manganese, aluminum, and total suspended solids—in three West Virginia/National Pollution Discharge Elimination System permits.
