Washington regional hospital Yakima HMA LLC must face a nurse’s proposed class action seeking to recover unpaid wages after the state supreme court on Thursday ruled it was timely filed.
The three-year statute of limitations should be equitably tolled because the nurse who brought the lawsuit raised the same claims that the hospital had litigated in a previous case, he didn’t sleep on his claims, nor engaged in wrongful conduct, the Washington Supreme Court said. The hight court reversed a lower court’s opinion that the nurse’s lawsuit fell outside the statute of limitations.
