The Washington Nationals Baseball Club LLC can contest whether a Christian scout refused Covid-19 vaccination based on sincerely held religious beliefs, a federal judge ruled.
The US District Court for the District of Columbia rejected the scout’s argument that the team conceded the issue through statements by its in-house counsel prior to the scout’s lawsuit.
The scout failed to cite any case law supporting “the novel proposition that prelitigation statements of a party as to an element of a claim can foreclose a party from contesting that element in litigation,” the court said Thursday.
