Walmart Legal Weed Job Bias Appeal Shines Light on Complex Issue

Walmart’s bid to uphold its job bias win against a New Jersey recreational cannabis user it turned away for employment will present the Third Circuit on Wednesday with a case of first impression: whether the state’s cannabis regulations allow a worker to sue an employer.

The appeal could also shine a light on the continuing clash between long-standing federal law criminalizing the possession and use of marijuana and the growing body of state laws giving rights to those using cannabis for medical or non-medical reasons.
