Walmart Fails to Undo EEOC’s Win for Worker With Down Syndrome

Walmart Stores East LP must pay the Equal Employment Opportunity Commission nearly $420,000 for a worker with Down syndrome who was denied a scheduling adjustment and reinstate her, because the trial evidence backed a jury’s finding that the company was aware of her need for an accommodation.

The evidence included testimony from Walmart managers that they knew Marlo Spaeth needed extra support when changes were made to her routine and that there was a need to work alongside Spaeth when she learned new tasks, the US District Court for the Eastern District of Wisconsin said.
