Walmart Avoids Some Claims in EEOC’s Disability Bias Lawsuit

Walmart Inc. failed to beat claims brought by the US Equal Employment Opportunity Commission that it violated federal law when it didn’t provide two deaf employees reasonable accommodations.

But there’s “nothing to suggest” either employee was faced with the decision to resign or lose their job to support the EEOC’s constructive discharge claim, Judge Toby Crouse of the US District Court for the District of Kansas said in an Aug. 8 order partially denying Walmart’s summary judgment motion.
