Walgreens Worker Fails to Get Wage Case Returned to State Court

A former Walgreens Co. worker who alleged various California labor law violations couldn’t convince a federal judge to send his proposed class action back to state court.

The federal court doesn’t have to remand the case back to the state court for lack of subject matter jurisdiction because Walgreens adequately calculated an estimated amount in controversy exceeding the Class Action Fairness Act’s $5 million threshold, said Judge Kenly Kiya Kato in an opinion Wednesday for the US District Court for the Central District of California, denying the worker’s motion to remand.
