Walgreens Worker Advances Class Claim Over Late Final Paychecks

Walgreen Co. must continue to litigate a former employee’s proposed class suit over allegedly untimely final wages, but not his related individual claims, a federal judge in Oregon ruled.

Plaintiff Taylor Lemons plausibly alleged that Walgreens violated Oregon wage law by providing employees with their last paychecks at their next pay period, rather than the next business day as required in the state, Judge Michael W. Mosman said.

Oregon law requires employers to follow a “tight turnaround” that “rarely” aligns with a regular biweekly pay schedule, the court noted in denying Walgreen’s motion to dismiss this claim.
