Walgreens Must Face Kentucky Opioid Suit in State Court

Walgreens must face Kentucky’s suit over its alleged role in the opioid crisis in state court.

Kentucky Attorney General Andy Beshear sued Walgreens Boots Alliance Inc. and related companies in June in Kentucky state court, alleging they failed to flag or stop suspicious opioid prescriptions in Kentucky.

Walgreens moved the suit to the U.S. District Court for the Northern District of Ohio, where it became part of the massive multidistrict litigation against drugmakers, distributors, and others.

But the federal court lacks jurisdiction over Kentucky’s suit, Judge Dan A. Polster, who oversees the MDL, said.
