Waldorf Astoria Must Defend Wage and Hour Claims in State Court

Waldorf Astoria Employer LLC and Waldorf Astoria Management LLC lost a bid to defend a proposed class action in federal court on behalf of their employees alleging wage and hour violations under the California labor code.

The companies removed the claims to federal court under the Class Action Fairness Act, asserting the class contains more than 100 members and the amount in controversy is greater than $5,000,000. Remanding the case to state court, Judge Mark C. Scarsi of the US District Court for the Central District of California said the defendants haven’t justified their estimate of the amount in controversy. ...
