Vitas Healthcare Lawsuit Advances Over Call-Center Recordings

Hospice-care provider Vitas Health Corp. must face a proposed class action alleging it enabled third-party software provider Invoca Inc. to record and analyze calls to its call centers in violation of the California Invasion of Privacy Act.

Plaintiff Charmaine Tate sufficiently pleaded that Invoca was a third party distinct from Vitas and that the software provider’s ability to use the recorded data for its own purposes could be sufficient to trigger liability under the CIPA, Judge Daniel J. Calabretta of the US District Court for the Eastern District of California said Wednesday.
