Visa Defeats Class Allegations of Gift Cards’ Scam Vulnerability

Visa USA Inc. on Monday defeated a proposed class action alleging the credit card giant deceptively marketed and sold gift cards that could easily be drained by thieves, and failed to compensate actual victims.

No reasonable consumer would fail to recognize the possibility that a gift card could be subject to a third-party scam, or would believe that a prominent Visa logo on the cards implied a promise that no scam could ever occur, Judge Gregory H. Woods of the US District Court for the Southern District of New York said.
