Virginia’s Fairfax County School Board defeated a teacher’s bid to revive a lawsuit alleging the denial of permission to work remotely to avoid mold and dust issues following lung surgery violated federal disability bias law.

Stephanie Thacker’s request for “temporary but total telework” wasn’t reasonable under the Americans with Disabilities Act because it wouldn’t have enabled her to perform all essential job functions while in place, the US Court of Appeals for the Fourth Circuit said.
