The Appomattox County School Board in Virginia will again face a claim that it didn’t do enough to stop harassment of a high school student who says she identifies as a boy.
A federal trial court erred in dismissing Michelle Blair’s claim of deliberate indifference, which concerns whether an educational institution that receives federal funds didn’t protect a student from a hostile or abusive environment, Judge Roger L. Gregory of the US Court of Appeals for the Fourth Circuit said in a Thursday opinion. Blair is the student’s grandmother and adoptive mother.
