Candy Dynamics Inc., maker of Toxic Waste Slime Licker, has sued competing confectioner Unbeatable Power LLC for allegedly advertising and selling a confusingly similar candy.
“Toxic Waste Slime Licker” became a “viral sensation on TikTok” in 2020, resulting in short-term increased demand, according to Candy Dynamics’ complaint filed Tuesday at the US District Court for the Southern District of Ohio.
The company claims that Unbeatable began advertising, promoting and selling its infringing “Tik Toxic,” with Cap Candy LLC’s name on the packaging, even after Unbeatable had attempted to trademark its mark, but was told it potentially infringed Candy Dynamics’ registration. ...
