Viking River PAGA Ruling Reversed After Supreme Court Remand (1)

A worker who sued Viking River Cruises Inc. alleging labor law violations under a unique California law must argue to the trial court she continues to have representational standing even though her individual claims must go to arbitration, the state appeals court ruled Thursday.

The unpublished opinion comes in a case the US Supreme Court remanded after ruling Angie Moriana must arbitrate her individual claims under the California’s Private Attorneys General Act, and returned it to the state for interpreting whether she can continue to represent a class of workers alleging misclassification.
