Verizon Defeats Bid to Overturn Cell Tower Construction Ruling

Verizon Wireless defeated a Pennsylvania zoning board’s effort to overcome a ruling that permitted the company to build a new cellphone tower.

White Deer Township’s zoning board asked the US Court of Appeals for the Third Circuit to reverse a district court decision which found the municipality’s attempt to block construction in violation of the Telecommunications Act.

But the panel affirmed the lower court, determining the board had “the effect of prohibiting the provision of personal wireless services.”
