Vegas.Com Can’t Shed Deceptive Pricing Consumer Class Lawsuit

Vegas.com LLC failed to convince a federal judge to force consumers to arbitrate or dismiss most of their claims that it lures customers by advertising low prices and then tacks on fees at checkout.

Judge Charles R. Breyer of the US District Court for the Northern District of California said Tuesday that the terms of use, which included an arbitration agreement, weren’t conspicuous enough for customers to assent. But he trimmed one of the consumers’ claims brought under California’s Consumer Legal Remedies Act.
