Vape Company Seeks Trademark Non-Infringement Ruling for Crave+

Sam’s International Group LLC, a Massachusetts vape developer, is seeking a declaration that its CRAVE+ mark doesn’t infringe the trademark of a New York-based competitor.

Sam’s says that it has sold CRAVE+ products—electronic cigarettes, vape cartridges, liquid nicotine solutions, amongst others—since 2019, and owns a portfolio of trademarks associated with CRAVE. Sol NY Corporation has sent cease and desist letters to Sam’s and wholesellers saying that CRAVE+ infringes Sol’s trademark on KRAVE for tobacco water pipes, according to the complaint filed in the US District Court for the District of Massachusetts.
