Utah State Bar Escapes Suit From Lawyer Over Mandatory Dues

The Utah State Bar is free from a lawsuit brought by a lawyer who said the state bar association’s mandatory dues are unconstitutional, a federal court has ruled.

Amy Pomeroy sued the bar, a nonprofit corporation, as well as its executives and board of commissioners. The plaintiff alleged that compelled membership in the bar, the bar’s collection of mandatory dues, the bar’s lack of dues safeguards, and compelled membership in the Utah Bar Foundation violates her First and Fourteenth Amendment rights.
