A key pharmaceutical industry trade organization filed a new lawsuit against Utah, alleging the state’s discount drug distribution law violated manufacturers’ constitutional protections.
The lawsuit, filed Friday by the Pharmaceutical Research and Manufacturers of America in the US District Court for the District of Utah, alleges that Utah Senate Bill 69 violated the Constitution’s Supremacy Clause by requiring drugmakers to offer discounted medications to an unlimited number of contract pharmacies within the state.
