The federal government is immune from claims by the former owner of a Chicago-area grocery store chain that the Federal Deposit Insurance Corp. “knowingly sold forged loan documents,” and published misleading information about the owners.
The claims—conversion; invasion of privacy and intrusion upon seclusion; intentional infliction of emotional distress; negligence and negligent infliction of emotional distress; and conspiracy—are exempt from suit against the government under the Federal Tort Claims Act because they are based in misrepresentation or deceit, Judge Marvin E. Aspen of the US District Court for the Northern District of Illinois said Monday.
