UPS Victorious in Driver’s Retaliation, Emotional Distress Suit

UPS won its bid to toss out an employee’s lawsuit alleging intentional infliction of emotional distress after he unknowingly was involved in a police operation the company knew about that caused him PTSD.

The US District Court for the Middle District of Florida granted United Parcel Service Inc. summary judgment in Adrian Mathews’ lawsuit alleging the company retaliated against his prior 2020 FMLA lawsuit and intentionally caused him emotional distress by allowing local law enforcement to engage in a sting operation involving a package on his truck that led to the arrest of the recipient.
