UPS’ Suit Challenging Postal Service’s Rate Calculation Tossed

The United Parcel Service Inc.‘s challenge to the Postal Regulatory Commission’s formula for computing the “appropriate share” of institutional costs covered by the US Postal Service’s competitive products won’t be reviewed by the DC Circuit.

The court previously remanded the case to the commission for clarification of its standard and its reasoning for accounting for specified statutory cost categories. "[T]he Commission adequately addressed the issues identified” by the court and “reasonably exercised its statutory discretion in adopting the appropriate share formula,” Judge Judith W. Rogers said in an opinion Friday, denying a petition for review.
