A UPS driver can’t keep $198 million in punitive damages a jury awarded him because “no evidentiary basis for such an award” was presented during his retaliation and wrongful discharge trial, a federal judge ruled.

To be entitled to punitive damages, Tahvio Gratton needed to show the sexual harassment investigation that resulted in his termination was caused by malice or reckless indifference to his right to be free from job retaliation, the US District Court for the Eastern District of Washington said.
