UPS Driver Gets Class Certified in Military Benefits Bias Suit

United Parcel Service Inc. must face as a class action a package driver’s lawsuit alleging it failed to pay him and other service-members differential pay for military leaves of 14 days or fewer while paying employees for other types of short-term leave.

The ruling Wednesday by the US District Court for the Eastern District of Washington rejected, for now, UPS’ argument that class certification wasn’t appropriate because issues involving individual class members’ monetary damages will predominate over common questions, including when each class member knew or should have known their rights under the Uniformed Services Employment and Reemployment Rights Act ...
