Upperline Narrows Online Tracker Class Suit to Single ECPA Claim

Upperline Health Inc. convinced a federal court to dismiss all but one claim from a proposed class action alleging that its use of online trackers violates the privacy of website visitors.

Judge Richard L. Young sided with Upperline on the plaintiff’s claims of public disclosure of private facts, negligence, and intrusion by seclusion, among other claims.

But he also ruled for the US District Court for the Southern District of Indiana that the alleged interception of website data is sufficient for an Electronic Communications Privacy Act claim.
