United Rentals North America Inc. asked the Texas Supreme Court on Wednesday to throw out a $5 million jury award for non-economic damages to the family of a man who died crushed by a collapsing beam because there isn’t enough evidence he was conscious before dying.
“The medical examiner admitted it’d be pure speculation for her to testify that he was conscious,” said attorney Brian Cathey of Wright Close & Barger LLP, representing the company.
