Union Pacific Defeats Black Engineer’s Bias, Retaliation Lawsuit

A Union Pacific Railroad Co. employee won’t get a trial on claims he was repeatedly denied promotion because he is Black and complained about race discrimination.

The longtime locomotive engineer lacked evidence he was competitive with the candidates picked for 12 of the jobs for which he said he’d been unlawfully passed over, the US District Court for the Southern District of Illinois said. As to a 13th promotion he sought and on which he timely sued, that job “was first offered to a Black candidate who turned it down,” the court said in its Wednesday ruling.
