Unilever United States Inc. said consumers alleging multiple subsidiary brands of dry shampoo contain harmful levels of a carcinogen lack standing to sue and that their labeling claims are preempted by federal law.
The consumers didn’t show that the products they bought contained benzene or that they thought they were buying something other than what they received so they lacked standing, Unilever said in its motion to dismiss filed Wednesday in the US District Court for the District of Connecticut.
