A lawsuit from 18 former University of California, Berkeley swimmers alleging their coach subjected them to years of verbal and psychological abuse isn’t barred by the statute of limitations, a California appeals court ruled Tuesday.
The appeals court reversed a trial court’s dismissal of the case after finding the discovery rule, which pauses the statute of limitations until a plaintiff actually discovers the alleged injury, may have delayed the accrual of the plaintiffs’ claims until May 2022, making them timely, Justice Monique Langhorne Wilson said in an opinion.
