Uber’s Sales Tax Case Needs New Look, Georgia Supreme Court Says

Uber Technologies Inc. will have another chance to argue that it isn’t liable for nearly $9 million in sales tax after the Georgia Supreme Court sent the case back to a lower court for analysis consistent with a 2025 ruling on separation of powers.

The Georgia Court of Appeals wrongly concluded that Uber was subject to a regulation covering taxicab dispatchers and was therefore responsible for collecting the sales tax for 2012-2015, the state justices said. The 1991 case the lower court relied on to determine that the applicable regulation was authorized by statute didn’t resolve that question, they said. ...
