Uber, Gig Employers Back at 9th Circuit Over Classification Law

Uber Technologies Inc., Postmates Inc., and other gig employers argued that California is unlawfully drawing distinctions between favored and unfavored app-based companies under a worker classification law that violates their constitutional rights.

An 11-judge panel of the US Court of Appeals for the Ninth Circuit during oral arguments Wednesday questioned the app-based companies’ contention that the organized labor-friendly California legislature singled out the gig industry out of hostility. The industry contends the California law “egregiously targets gig-economy network companies,” like plaintiffs Uber and Postmates, and “irrationally discriminates against those who use their platforms.”
