Uber Arbitration Disclosure Rejected Again by Pennsylvania Panel

Uber Technologies Inc. lost an en banc Pennsylvania appellate court argument over whether a wheelchair user injured during an Uber ride agreed to resolve such a claim through arbitration.

Pennsylvania law treats the right of a jury trial as inviolable, Judge Daniel D. McCaffery said Wednesday. Writing for the 6-3 panel, he also said Uber had not given the suing couple, Shannon and Keith Chilutti, “reasonably conspicuous notice” of the terms to which they were agreeing when they created their respective ride-share accounts.
