U.S. Wrongly Evaluated Veteran’s Agent Orange Claim, Court Says

The Federal Circuit found the Department of Veterans Affairs’ argument that it should deny a Navy Seabee compensation for his alleged Agent Orange exposure in the Vietnam War “unpersuasive,” and said Wednesday the agency needed to weigh all the relevant science.

The U.S. Court of Appeals for the Federal Circuit vacated and remanded the lower court’s decision because it declined to consider the National Academies of Science’s 2014 findings on Agent Orange exposure in connection with the claim Robert M. Euzebio filed.
