U by Kotex Tampon Maker Can’t Shake Lead Deception Class Suit

Kimberly-Clark Corp., the maker of U by Kotex tampons, failed to convince a federal judge to toss a proposed class action alleging it tricked consumers into thinking the tampons are free from lead when they weren’t.

The US District Court for the Southern District of California largely denied the company’s motion to dismiss Wednesday, but trimmed one of the consumer’s claims.

Plaintiff Allison Barton alleged independent testing of the Kotex tampons found lead well above the maximum allowable dose level established by California’s Proposition 65. She said packaging statements including “no harsh ingredients” and “gynecologist tested” made consumers believe ...
