Tyson Foods Immune From Covid-Related Plant Worker Death Lawsuit

The widow of a former Tyson Foods Inc. employee who allegedly died because of the company’s deficient response to the Covid-19 pandemic is barred from suing under Pennsylvania common law, a federal judge in Philadelphia ruled.

The Pennsylvania Workers Compensation Act provides the exclusive remedy for workplace injuries and makes employers immune from negligence and similar claims based on such injuries, the U.S. District Court for the Eastern District of Pennsylvania said Monday.
