Two Texas companies must face a lawsuit over the death of a man killed by a driver in their employ who allegedly fell asleep during a 500 mile drive to a jobsite.

Although state precedent bars claims under the “coming and going rule,” meaning that companies aren’t liable for their worker’s actions to and from work, there’s enough evidence that employee Adrian Samuel was carrying a specific work tool, classifying the trip as a “special mission” instead, the Texas Court of Appeals, Eighth District said.
