Two Religious United Workers Win New Look at Covid Vaccine Rule

United Airlines Inc. must again defend against an attempt by religious employees to temporarily block enforcement of the company’s Covid-19 vaccination mandate, a divided Fifth Circuit ruled Thursday.

A federal district court in Texas got it wrong when it found David Sambrano and Genise Kincannon can’t show the sort of irreparable harm needed for a preliminary injunction under federal law, the 2-1 court said.

It’s “extraordinary and rare” that an injury covered by federal workplace discrimination law can’t be remedied after prevailing in a lawsuit,the court said.
