Twitter Account Suspension Suit Can Proceed Over Advertiser Duty

Twitter again failed to have a lawsuit tossed that alleges the social media giant in early 2022 unfairly suspended the accounts of a news site, in breach of their advertising contract.

The California Court of Appeal, First District upheld a lower court ruling that the case survives a motion to dismiss.

The claims against Twitter are related to its editorial decisions, which are protected by the First Amendment, but the arguments from the company that launched the account are strong enough to overcome the platform’s motion to strike under the state’s anti-Strategic Lawsuits Against Public Participation statute, justices ruled.
