Turkey Price-Fixing Litigation Against Major Suppliers Advances

Butterball LLC, Perdue Farms Inc., and seven other suppliers lost their joint bid to dismiss claims they fixed the price of turkeys, because a conspiracy could be inferred from the plaintiffs’ allegations.

The direct purchaser plaintiffs, including food distributor Maplevale Farms Inc., and indirect purchaser plaintiffs, including restaurants like Sandee’s Bakery, claim that defendants shared non-public information with one another and engaged in parallel conduct, including supply reductions between 2008–2009 and 2012–2013.

Winn-Dixie and its parent companit Bi Lo Holdings are among the plaintiffs in the consolidated litigation, but have brought their claims in a lawsuit directly against the defendants. ...
