The Trump administration can’t tie billions of dollars in transportation funds to states’ cooperation with civil immigration enforcement, a federal court in Rhode Island said Tuesday.
By placing the condition on the funds, the administration “blatantly overstepped” its statutory authority, violated the Administrative Procedure Act, and “transgressed well-settled constitutional limitations on federal funding conditions,” Chief Judge John J. McConnell Jr. said for the US District Court for the District of Rhode Island.
“The Constitution demands the Court set aside this lawless behavior,” McConnell added.
