DOJ Sues Kentucky Over Immigrant In-State Tuition Policy (2)

Kentucky is allowing individuals who are unlawfully in the US to qualify for in-state tuition rates in violation of federal law, the US Department of Justice asserted Tuesday.

The policy “expressly and directly conflicts with federal immigration law because it enables an ‘undocumented alien’” to qualify for reduced tuition at public colleges, while requiring US citizens from other states to pay higher tuition rates, the federal government alleges in a complaint filed in the US District Court for the Eastern District of Kentucky.
