The US Department of Labor is facing yet another lawsuit challenging the legality of its newly-minted worker classification rule, the second to be filed by a family-owned trucking company.
Colt & Joe Trucking LLC alleges that the rule, which took effect March 11, violates the Fifth Amendment’s due process clause by imposing penalties without specifying “what conduct is punishable,” according to the complaint filed in the US District Court for the District of New Mexico Thursday.
