A group of travel nurses defeated the US Nursing Corp. and Fastaff LLC’s bid to escape claims the companies unlawfully lower pay rates after signing assignment contracts.
Although the pleadings show that the plaintiffs continued working after Fastaff reduced their pay rates, they “do not establish that Plaintiffs continued working ‘after knowledge the fraud’” that would waive their fraud-based claims, Chief Magistrate Judge Michael E. Hegarty of the US District Court for the District of Colorado wrote in a Dec. 27 order.
