Transgender Youths Oppose Full Court Review in Care Ban Appeal

There’s no good reason to depart from normal procedure and hold an initial full-court review of a decision that permanently barred Arkansas’ first-in-the-nation gender-affirming care ban for minors, the law’s challengers told a federal appeals court.

The US Court of Appeals for the Eighth Circuit should deny the state’s motion for en banc review prior to the case’s submission to a three-judge panel—the usual course for appeals filed in the court, the transgender minors, their doctors, and their parents said in Thursday’s brief.

Arkansas’ request “is extraordinary and unprecedented,” the plaintiffs said.
