Transgender Inmates’ Sexual Assault Claims Survive Dismissal Bid

Several California corrections officials must face a civil rights suit after a federal judge in the state denied a bid to dismiss constitutional claims by two transgender inmates related to alleged sexual assaults and harrassment.

The decision shows that claims that are factually connected and plausibly alleged can survive a motion to dismiss.

Tarryn Unique and Miguel White alleged California Department of Corrections and Rehabilitation staff psychologist Joseph Claybaugh sexually abused them and several CDCR officials were negligent in not preventing the abuse. They sued Claybaugh for sexual assault under the Eighth Amendment.
