A Touro University dental student who said the school breached an implied contract by switching from in-person learning during the Covid-19 pandemic can pursue his suit on behalf of other students.
Mark Yodice said that Touro promoted the benefits of its dental program’s in-person learning environment before the 2020 pandemic. Yodice’s complaint was sufficiently similar to a case against New York University that the US Court of Appeals for the Second Circuit revived his proposed class action in a summary order.
