A former dental student at the Touro College and University System lacks evidence that the school was enriched by collecting his tuition for the Spring 2020 semester, when classes were moved online because of the Covid-19 pandemic.
Judge Denise Cote, of the US District Court for the Southern District of New York, on Tuesday granted summary judgment to Touro on Mark Yodice’s unjust enrichment claim, after ruling that Yodice isn’t entitled to a partial refund of his tuition. Cote also rejected Yodice’s bid for class certification.
